Terms of Service
§1 Scope These Terms of Service apply to all purchases made through the Enchanted Sacks online store between Enchanted Sacks (Kevin Chow, Schönleinstraße 29, 10967 Berlin, Germany) and the customer. Any differing terms proposed by the customer are not accepted unless explicitly agreed to in writing.
§2 Order Process Product listings in our store are an invitation to purchase, not a binding offer. By clicking "Pay now" you submit a binding offer to purchase the items in your cart. A contract is formed when we send you an order confirmation by email, which will also include these Terms of Service.
§3 Prices All prices are final and inclusive of any applicable taxes. As a small business under §19 UStG (German VAT Act), we do not charge VAT. Shipping costs are shown separately during checkout. For deliveries outside the EU, additional costs such as import duties or taxes may apply and are the responsibility of the customer.
§4 Payment We accept PayPal and any other payment methods shown at checkout. PayPal payments are processed by PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.
§5 Delivery We deliver to the address provided at checkout. Standard production and delivery time is 2-3 weeks from order confirmation, as all items are handmade to order. Delivery times for custom orders may vary and will be communicated individually. Risk passes to the customer once the item is handed to the carrier.
§6 Retention of Title All goods remain our property until payment is received in full.
§7 Right of Withdrawal Consumers have a 14-day right of withdrawal. Please see our Return & Refund Policy for full details. Custom frame bags and items made to personal specification are excluded from the right of withdrawal under §312g BGB.
§8 Warranty Your statutory warranty rights apply. We guarantee that products are free from defects at the time of delivery. Please note that slight variations in material, color, and finish are a natural characteristic of handmade goods and do not constitute defects.
§9 Liability We are fully liable for intent and gross negligence, and in accordance with the German Product Liability Act. For minor negligence, liability is limited to breaches of essential contractual obligations, and capped at foreseeable, contract-typical damages. Liability for injury to life, body, or health is unlimited.
§10 Care Instructions Our products are designed for carrying items by bicycle. To maintain quality: hand wash only with mild soap, do not machine wash, do not tumble dry, air dry only. Warranty claims may be void if products are improperly used or cared for.
§11 Intellectual Property All content on this website including images, text, and graphics is protected by copyright. Use without our explicit permission is prohibited.
§12 Dispute Resolution The EU Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.
§13 Governing Law These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For business customers, the place of jurisdiction is Berlin.
